These actionable recommendations underscore the need for a balanced, multilateral approach to cbdt that can enhance regulatory convergence, reduce fragmentation, and facilitate secure, rights based data transfers globally. This paper examines the theoretical and practical implications of cross border data flow regulation and data localization measures from economic, legal, and geopolitical perspectives. Abstract: in modern international competition and cooperation, digital trade rules centered on the cross border flow of data have become a competitive advantage for countries. under the guidance of commercial freedom, the united states chooses to actively promote the free flow of data across borders. Countries have developed a range of unilateral policies and regulations to govern the flow of data that result in barriers for moving data across borders. What cross border data transfers are a cross border data transfer (international transfer) happens when personal data is sent, made accessible, or otherwise transferred from one jurisdiction to another—especially from the eu eea or switzerland to a country without an “adequate” level of protection under the applicable legal regime. The critical policy issue related to cross border data fl ows is their potential restriction, particularly through data localization requirements. these requirements force organizations to restrict data access, sharing, and re use within national borders. The book first demonstrates that there is a real clash between international trade law and european data privacy law when it comes to the governance of cross border flows of personal data.
