Misconduct is any action or behaviour by an employee that has been determined by a breach decision maker to be contrary to the code. the action or behaviour does not generally require intent to be present in order for it to be considered a breach. The australian public service (aps) code of conduct (code of conduct) sets out the standards of conduct and behaviour required of all aps employees as defined in section 13 of the public service act 1999 (cth) (ps act). The requirements of this section are met if the commissioner acts under paragraph 72(1)(c) or (d) of the act to engage a person, or determine that a person becomes engaged, in a specified agency. These procedures apply in determining whether a person who is an employee in the department, or who is a former employee who was employed at the department at the time of the suspected misconduct, has breached the australian public service (aps) code of conduct (the code), in section 13 of the act. The public service act 1999 (the act), subsection 15(3), requires that an agency head must establish procedures for determining whether an aps employee, or former aps employee, in the agency has breached the code of conduct (the code) and what sanctions, if any, should be imposed.
